On the protection of the rights of medical staff during the prevention and control of epidemic situation

Abstract:

The Basic Medical Hygiene and Health Promotion Law passed on December 28, 2019 clearly stipulates that medical personnel have the right to personal safety and inviolability of their personal dignity, which has opened up new chapter of China′s legislation to strengthen the protection of the rights and interests of medical professionals as a special occupational group. However, during the epidemic of the new crown pneumonia (Covid-19), there may have problems in which the legal rights and interests of medical staff have been damaged in the front-line prevention and control work. During the epidemic prevention and control, medical staff′s right to life and health, mental health, restand work injuries were lack of protection, so corresponding suggestions are made, including optimizing the protection of the rights of medical personnel by legislation, establishing an intervention mechanism for medical personnel′s psychological crisis, strengthening the supervision of medical personnel′s rest. During the epidemic period, the regulations on work injury should be applied flexibly.
